Terms of Service

These Terms of Service ("Terms") govern your access to and use of Postack ("we", "us", "our"), including the website at trypostack.com, the application at postack.io, and all related services (collectively, the "Service").

By creating an account, signing up for Early Access, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

You must be at least 16 years old to use Postack. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

If you are using Postack on behalf of an organization (agency, brand, or company), you represent that you have authority to bind that organization to these Terms.

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete information when creating your account
• Keep your login credentials confidential
• Notify us immediately if you suspect unauthorized access to your account
• Not share, transfer, or sell your account to another person

We are not liable for any loss arising from unauthorized use of your account.

Postack is an AI-powered content operating system that helps creators and brands:

• Capture and organize content ideas
• Generate platform-specific content drafts using AI
• Schedule and publish posts across connected social media platforms
• Manage engagement and automate responses (e.g., "Comment the Word" campaigns)
• Analyze content performance and optimize posting strategies

We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for material changes that affect your use.

You own your content. All ideas, drafts, posts, themes, brand voice settings, and other content you create through Postack remain your intellectual property. We do not claim ownership of any content you create or upload.

License to operate: By using the Service, you grant us a limited, non-exclusive license to store, process, and transmit your content solely to provide the Service — for example, to generate AI drafts, publish to your connected platforms, and display content in your dashboard.

This license terminates when you delete your content or your account. We do not use your content for advertising, resale, or to train third-party AI models.

Postack uses artificial intelligence (powered by Anthropic's Claude) to generate content suggestions, drafts, and recommendations. You acknowledge that:

• AI output is a suggestion, not a guarantee. You are responsible for reviewing, editing, and approving all content before it is published.
• You own what you publish. Once you approve and publish AI-generated content, it becomes your content and your responsibility.
• AI-generated content may occasionally be inaccurate, incomplete, or unsuitable. Postack is not liable for any consequences of publishing AI-generated content.
• You should not rely on AI-generated content for legal, medical, financial, or other professional advice.

When you connect third-party social media accounts to Postack:

• You authorize us to access and interact with those platforms on your behalf, within the scope of permissions you grant during the OAuth flow
• You are responsible for complying with each platform's own terms of service
• We are not responsible for actions taken by third-party platforms (e.g., rate limiting, account suspension, content removal, API changes)
• You may disconnect any platform at any time — OAuth tokens are immediately purged upon disconnection

You agree not to use Postack to:

• Violate any applicable laws or regulations
• Publish spam, misleading, or deceptive content
• Harass, threaten, or abuse other individuals
• Distribute malware, phishing attempts, or harmful code
• Infringe on intellectual property rights of others
• Scrape, crawl, or harvest data from the Service or connected platforms
• Attempt to circumvent rate limits, security measures, or access controls
• Use the Service to generate content that violates any connected platform's community guidelines
• Resell, sublicense, or commercially redistribute the Service without our written consent
• Reverse engineer, decompile, or disassemble the Service

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice depending on the severity of the violation.

Postack offers both free and paid subscription plans. For paid plans:

• Prices are displayed before you subscribe and may change with 30 days' notice
• Subscriptions renew automatically unless cancelled before the renewal date
• You may cancel your subscription at any time — access continues until the end of the current billing period
• Refunds are handled on a case-by-case basis; contact us at support@postack.io
• We do not store your payment card details — payments are processed by a PCI-compliant third-party provider

Your use of Postack is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. The Privacy Policy is incorporated into these Terms by reference.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Uninterrupted, error-free, or secure operation
• Accuracy or reliability of AI-generated content
• Compatibility with any particular social media platform
• Achievement of any specific results from using the Service

Social media platforms may change their APIs, policies, or terms at any time, which may affect Service functionality. We are not responsible for such changes.

To the maximum extent permitted by law, Postack and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities
• Content published through the Service that causes harm or liability
• Unauthorized access to your account due to compromised credentials
• Service interruptions or downtime
• Actions taken by connected third-party platforms

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

You agree to indemnify and hold harmless Postack and its team from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Content you create, publish, or distribute through Postack
• Your violation of these Terms or any applicable law
• Your violation of any third party's rights

By you: You may delete your account at any time. Upon deletion, we will permanently remove your data in accordance with our Privacy Policy (within 30 days).

By us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. We will provide notice where reasonably possible and allow you to export your data before permanent deletion.

Sections on Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification survive termination.

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service will first be addressed through good-faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration, except where prohibited by law.

Nothing in these Terms limits your statutory rights as a consumer.

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of Postack after the effective date constitutes acceptance of the updated Terms.

If you disagree with the updated Terms, you may delete your account before the changes take effect.

Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Postack regarding the Service.

No Waiver: Our failure to enforce any provision does not waive our right to enforce it later.

Assignment: You may not assign your rights under these Terms. We may assign ours in connection with a merger, acquisition, or sale of assets.
